1. Who we are; acceptance of these Terms
Lumina AI, available at practicalnurseprep.com, is a CPNRE examination-preparation platform owned and operated by NGN Simulation Labs Ltd., an Alberta corporation with its registered office at 11 South Shore Rd, Chestermere, AB T1X 2Y4, Canada ("Lumina", "NGN Simulation Labs", "we", "us"). Lumina AI is a product of NGN Simulation Labs Ltd.; these Terms govern the Lumina AI services specifically.
The "Services" means the Lumina AI platform and related services: the AI tutor, practice questions and rationales, full exam simulations, clinical case scenarios, NGN-style clinical-judgment items, study plans and study notes, spaced-repetition review, voice-based OSCE and speaking practice, career tools, the institution portal, the free guides published on this site, and any other features we offer now or in the future.
PLEASE READ THESE TERMS CAREFULLY. BY REGISTERING FOR, ACCESSING, OR USING THE SERVICES YOU AGREE TO BE BOUND BY THESE TERMS AND ACKNOWLEDGE OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES.
If you are an instructor, program director, or administrator ("Institutional Personnel") provisioning access for learners on behalf of a college or other organization (an "Institution"), you represent that you are authorized to accept these Terms for your Institution, unless a separate written Master Services Agreement between your Institution and NGN Simulation Labs Ltd. governs instead, in which case that agreement controls in the event of a direct conflict.
2. Eligibility
You must be at least 17 years of age to register. If you are 17 but under the age of majority in your jurisdiction, you may use the Services only (a) as part of a program arranged by an Institution, or (b) with a parent or legal guardian who has reviewed and accepted these Terms on your behalf. The Services are not directed to, and may not be used by, anyone under 14 years of age. The Services are not available to anyone we have previously suspended or removed. The Services are operated from Canada and are designed for Alberta practical-nursing candidates; access is prohibited where unlawful.
3. Accounts
You are responsible for the confidentiality of your credentials and for all activity under your account, which is personal to you and may not be shared or transferred. Provide accurate information and keep it current. If you suspect unauthorized access, contact hello@albertalpnprep.com immediately. Instructor and administrator capabilities are restricted to verified Institutional Personnel, and we may verify institutional credentials before activating them.
4. Institutional use
- Educational aid. The Services supplement — and never replace — institutional assessment, accredited clinical training, and faculty judgment.
- Consents and notices. Institutions are solely responsible for the notices and consents required under legislation applicable to them — including Alberta's Freedom of Information and Protection of Privacy Act (FOIP) for public bodies and PIPEDA — for their learners' access to the Services and any cross-border processing described in our Privacy Policy.
- Instructor visibility. Learners whose access is provisioned by an Institution acknowledge that authorized Institutional Personnel may review their scores, progress analytics, simulation transcripts, and related learning records for academic administration.
5. Free access, trials, subscriptions and billing
- Free to start. Self-serve learners currently receive a full-access trial period followed by an ongoing free tier. Institutional access is governed by the Institution's agreement with us.
- When paid plans are offered: prices, billing intervals, and applicable taxes (GST/HST/PST, calculated by purchaser location) are displayed before checkout, in Canadian dollars unless stated otherwise, in accordance with Alberta's Consumer Protection Act and the Internet Sales Contract Regulation. Payments are processed by Stripe; we never store full card numbers.
- Renewals and cancellation. Any subscription renews automatically at the then-current rate unless cancelled before renewal, from account settings or by emailing hello@albertalpnprep.com; cancellation takes effect at the end of the current billing period.
- Price changes take effect on at least thirty (30) days' advance notice by email.
- Refunds. First-time purchasers of an annual plan may request a full refund within fourteen (14) days of purchase. Other purchases are non-refundable except as required by mandatory consumer-protection law of your residence, which these Terms do not limit.
6. Educational use only; no medical advice
The Services — including every simulated scenario, AI response, rationale, and voice interaction — are provided solely for education and exam practice. They are not medical, nursing, diagnostic, or clinical advice and must never be used in connection with real patient care. All patient profiles in the Services are fictional. You are strictly prohibited from entering identifiable real patient health information into the Services.
NGN Simulation Labs Ltd. is an independent education-technology company. We are not affiliated with, endorsed by, or sponsored by any nursing regulator or examination body — including the College of LPNs and HCAs of Alberta (CLHA). CPNRE®, NCLEX®, REx-PN®, and other marks are the property of their respective owners and are used strictly for nominative, educational-alignment purposes. We do not guarantee any exam result or employment outcome.
7. AI-enabled features
Our AI features rely on probabilistic models and their outputs may occasionally contain factual or clinical errors. You are required to verify clinical information independently against authoritative texts and current guidelines. Our AI infrastructure runs on enterprise Google Cloud (Vertex AI) terms under which the provider is restricted from using your inputs or outputs to train general-purpose foundation models.
8. Voice and audio features
Microphone audio captured during voice OSCE stations and speaking practice is processed transiently to produce transcripts and delivery metrics (pace, clarity, pauses). We do not create biometric voiceprints and do not use audio for biometric identification. See the Privacy Policy for retention details.
9. Intellectual property and user content
- Ours. NGN Simulation Labs Ltd. retains all right, title and interest in the Services, software, question banks, scenario content, prompts, analytics, and branding. We grant you a limited, non-exclusive, revocable licence for personal, non-commercial educational use (or internal institutional use). Scraping, bulk extraction, reverse engineering, and use of our content to train third-party AI models are prohibited.
- Yours. You retain ownership of content you author (notes, uploads, responses). You grant us a non-exclusive, royalty-free, worldwide licence to host and process it solely to operate, maintain, secure, and improve the Services, including using de-identified, aggregated interaction data to refine the platform.
- Institutional content. Institutions and instructors retain ownership of custom content they author, granting us a non-exclusive licence to host and render it for their designated cohorts.
10. Prohibited conduct
You agree not to: (a) resell or commercially exploit the Services; (b) enter real patient health information; (c) engage in academic dishonesty or breach the confidentiality of any licensing examination; (d) scrape, reverse engineer, or extract platform code or content; (e) circumvent tenant isolation or security controls; or (f) use the Services to develop or train competing AI models.
11. Copyright complaints
Notices under Canada's Copyright Act notice-and-notice regime or the US DMCA should be directed to hello@albertalpnprep.com or by mail to NGN Simulation Labs Ltd., 11 South Shore Rd, Chestermere, AB T1X 2Y4.
12. Certificates
Completion certificates issued by the platform evidence activity on the platform only. They do not confer academic credit, clinical hours, licensure, or regulatory registration unless expressly recognized by your Institution or regulator.
13. Changes to these Terms
We may update these Terms on at least thirty (30) days' advance notice by email or platform notification. If an Institution objects in writing within 30 days to a material change affecting learner privacy rights, the prior terms remain in effect for that tenant until the end of its current subscription term.
14. Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify and hold harmless NGN Simulation Labs Ltd. and its officers, directors, employees and agents from third-party claims arising out of your breach of these Terms or misuse of the Services. This indemnity does not apply to consumers to the extent restricted by applicable consumer-protection legislation.
15. Warranty disclaimer
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, NGN SIMULATION LABS LTD. DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. STATUTORY CONSUMER GUARANTEES THAT CANNOT BE WAIVED REMAIN UNAFFECTED.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NGN SIMULATION LABS LTD. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF DATA. OUR TOTAL AGGREGATE LIABILITY UNDER THESE TERMS IS CAPPED AT THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) CAD $100. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE CONSUMER-PROTECTION LAW.
17. Governing law; disputes
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any proceeding arising out of these Terms shall be brought exclusively in the courts of the Province of Alberta sitting in Calgary, Alberta, and each party irrevocably submits to that jurisdiction. Claims are subject to the statutory limitation periods of the Alberta Limitations Act.
18. General
If any provision is held invalid, the remainder continues in full force. Failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a corporate reorganization, merger, or sale of the business.
